Alternative investments
We advise a number of large superannuation funds and other collective investment vehicles in relation to their investments in alternative assets, including domestic and offshore private equity funds, infrastructure funds, global real estate funds and timberland ventures.

Acted on the drafting of the industry standard trust deed.
Babcock & Brown
Advised Babcock & Brown Direct Investment Fund Limited on the establishment of the Direct Investment Fund Equity Trust and the Direct Investment Fund Mezzanine Debt Trust.
Babcock & Brown Direct Investment Fund (B&B DIF)
Acted for B&B DIF in the acquisition, in partnership with Babcock & Brown, of an interest in the Braemer gas-fired peaking power station start-up project
and in its participation in a consortium which acquired an interest in Eircom,
the Irish telecommunications carrier which is listed on the London Stock
Exchange.
Babcock & Brown Direct Investment Fund Mezzanine Debt Trust
Acted on its participation in a syndicate participating in the acquisition financing of railcars in the United States through a series of Cayman and Delaware LLCs, and on its participation in a syndicate participating in the acquisition and leasing of certain aircraft in the United States through a Delaware LLC.
Fund of Funds - Global Real Estate Fund
Acted for clients, including Australian and US-based fund managers in relation to the establishment of a series of Australian-domiciled fund of fund vehicles investing in global real estate funds.
Golden Circle
Acted for the Babcock & Brown Direct Investment Fund in the acquisition of an interest in Golden Circle in partnership with Babcock & Brown, the Queensland based fruit canning and fruit juice business.
Life Sciences Private Equity Fund
Acted for a large Australian life sciences fund on the establishment of the fund and trustee/manager completely from start-up.
Macquarie Financial Products Manangement Limited
Acted on the restructure of the Four Corners Sentinel, a fund which invests into structured product and derivatives.
Macquarie Airports Group
Acted for Macquarie Bank in the establishment of the private equity investment company Macquarie Airports Group, set up through a Bermuda mutual fund company.
MPM Capital
Advising MPM Capital, a global healthcare private equity investor, on a proposed investment in an ASX-listed company in the healthcare sector.
Westpac Banking Corporation
Acted for Westpac in the establishment of Bluewater Funds Management SPC in the Cayman Islands, a capital protected product. Investments in Bluewater provide investors with exposure to Gottex Market Neutral (hedge) Fund.
Westpac Private Equity
Acted on the establishment of its Quadrant Capital Funds Nos 1, 2 and 3.
