Anti-counterfeiting – Recent experience
Over the years we have represented a large number of clients across many different industries, on a variety of anti-piracy issues, including:
Entertainment industry
- Sony Computer Entertainment Australia – advising on their national anti-piracy campaign pursuing infringers of PlayStation games and consoles, involving over 2000 investigations and 120 cases before the Federal Court; and
- Record Companies – advising major record companies including Sony BMG Music Entertainment and CBS.
Sporting industry
- Australian Grand Prix Corporation – co-ordinating anti-counterfeiting measures during the 2008, 2007 and 2006 Australian Formula One Grand Prix and the 2007 and 2006 Australian Motorcycle Grand Prix; and
- Acushnet – assisting a golf equipment manufacturer on customs seizure matters in relation to their products.
Food & beverage industry
- Kraft – advising on counterfeit issues associated with illegal reproduction t-shirts;
- Jim Beam – advising on issues associated with the manufacture and sale of counterfeit Jim Beam products; and
- Simplot Australia Pty Ltd – advising on the parallel importation of John West tuna products manufactured for the UK market into Australia.
Clothing & accessories industries
- The Décor Corporation – advising in relation to counterfeit issues associated with its plastics houseware range;
- MGA Entertainment – advising on all counterfeit issues associated with the importation of counterfeit toys, clothing and other MGA Entertainment products;
- Champion – advising in relation to counterfeit issues associated with the Champion range of sports apparel;
- LVMH – working with a range of LVMH subsidiaries, Christian Dior, Tag Heuer, Kenzo, Guerlain, Givenchy and Zenith Watches, on anti-counterfeiting and trade mark enforcement issues in Australia;
- Longchamp – advising in relation to the enforcement and protection of Longchamp bags; and
- Proctor & Gamble Australia – advising on the importation of counterfeit products by third parties.
Motor vehicle industry
- Ford – advising on the establishment of a customs procedure in Australia designed to deter the importation of infringing Ford goods.
Merchandise
- Melbourne 2006 Commonwealth Games – as the Official Law Firm for the Melbourne 2006 Commonwealth Games we advised on a wide range of matters including counterfeiting issues associated with Games merchandising; and
- Victoria Racing Club – advising on a wide range of matters including licensing and actions against those involved in selling unauthorised merchandise.
