Australia's energy industry faces a period of unprecedented change, spurred by national competition policy, State Government reforms and a growing international focus on renewable energy.

Disaggregation, corporatisation and privatisation have broken down traditional energy markets, creating major opportunities for investors, financiers and operators.

We've been there to negotiate complex legal issues, whether helping governments plan and implement reform or assisting established and new players in the business of generation, transmission, distribution and supply.

We advise on the full spectrum of legal issues including mergers and acquisitions, build-own-operate energy projects, electricity and gas purchase contracts, agreements for transmission and for coal and gas supply and transportation, hedging and commodity marketing. We advise on operations agreements, third party access, competition law and national electricity market issues, as well as foreign investment and environment law.

Our team has an in-depth understanding of the industry. We comprise specialists in electricity and gas industry regulation, competition policy, environmental regulation, industrial relations, project finance, corporate restructuring, privatisation and corporatisation. We also have access to the expertise of lawyers in other groups within the firm, as required, in areas such as financing or taxation.

We have negotiated contracts with retailers, network operators, financiers and those interested in developing or bidding for new capacity or for the sale of existing electricity assets.

Insight into industry reform

We've played a role in some of the most successful Australian and international privatisation transactions.

We set up an office in South Australia to work with the State to disaggregate and privatise its electricity supply industry - a highly complicated transaction that also required drafting a new legislative and regulatory framework.

We advised the Victorian Government on electricity and gas industry reform and continue to advise on legal and regulatory requirements to introduce full industry contestability. We acted in a large number of significant gas and electricity projects in the Asia Pacific region. These have included assisting the Indonesian Government in preparing a new electricity law as well as acting for Federal and State statutory and private sector bodies in Australia.
