Our recent experience includes advising:

Subscription Television

  • FOXTEL, News Limited and Premier Media Group – successfully acting for these clients in Federal Court proceedings concerning claims that the acquisition of the AFL rights by News and the on sale of those rights to FOXTEL, Nine and Ten, the acquisition of the NRL pay rights by Premier Media and the content supply agreement between FOXTEL and Optus breached Part IV of the Trade Practices Act 1974 (Cth)
  • Star – advised on broadcasting and regulatory issues across the Asia-Pacific region including on its acquisition of a stake in Indonesian national terrestrial television broadcaster, PT Cakrawala Nadalas Televisi

Broadcasting

  • Melbourne 2006 Commonwealth Games – advised on the broadcasting rights agreements with Publishing and Broadcasting Limited (the Nine Network) and with Telstra Corporation Limited
  • International Olympic Committee – advised on the broadcasting agreements for the 2008 Beijing Olympic Games, and the Winter and Summer games in 2010 and 2012
  • International Rugby Board – advised on the broadcasting rights for the 2007 Rugby World Cup
  • National Indigenous TV – advised on negotiations with FOXTEL to retransmit National Indigenous TV's service on FOXTEL's basic TV tier

New Media

  • AOL LLC – advised on the Australian law aspects of the acquisition of the social networking site Bebo, Inc
  • Walt Disney – advising on a range of co-production, format licensing and mobile content licensing projects in China, as well as advising on its acquisition of Gamestar

Radio & Music

  • Sony BMG Music Entertainment – drafting and negotiating music publishing agreements with artists such as Delta Goodrem and Ben Lee, recording agreements with artists such as Rogue Traders and representing Sony BMG in copyright infringement disputes.
  • Macquarie Media Group – acted on the establishment of the MMG and its listing on the Australian Stock Exchange. We have subsequently advised on the acquisition of a strategic stake in Southern Cross Broadcasting, the acquisition of a radio station and on privacy and telemarketing compliance
  • News Limited – advised on its sale of Festival Mushroom Records (FMR) to Warner Music Australia, and the FMR music publishing business to the Mushroom Music group

Film and Video

  • The Fox Group – advised on intellectual property, film financing and distribution matters in Australia and China
