Advising BHP Billiton on their strategic alliance and multiple joint ventures
with PT Antam Tbk (an Indonesian state-owned mining company) to develop a
multi-billion dollar nickel processing facility in East Indonesia.
BP
Advised on all legal aspects of the US$1.4 billion Nam Con Son gas pipeline and
Phu My 3 BOT power plant, including business cooperation contract, BOT contract,
EPC contracts, gas sales agreement, power purchase agreement, government
guarantee, partial divestiture by BP and project financing.
Gamuda
Acting for Gamuda (Malaysia) on a Build-Transfer project for a water sanitation
facility. This is a large scale project which will significantly improve the
high effluent situation resulting from a concentration of small workshops around
Hanoi.
Holcim Vietnam Limited
Drafted, tendered and negotiated all main construction and related contacts with
foreign and domestic suppliers and contractors in relation to the Hon Chong, Cat
Lai and Thi Vai cement plants.
Hutchison Port Holdings
Advising on a potential joint venture with Saigon Investment Construction and
Commerce Co Ltd (a Vietnamese company) to establish a port facility near Ho Chi
Minh City.
International Finance Corporation (IFC)
Advising on a US$100 million financing package for the development of
substantial telecommunications infrastructure in Cambodia.
Itochu Corporation, Sumitomo Bank, Chase Manhattan Bank and Daichi
Represented the syndicate in relation to the US$450 million project financing
part of the costs associated with the development of gas-wells gathering and
collection facilities and a gas processing plant, to be installed at the area
which is subject of Asamera Oil's Corridor Block Gas PSC – Sumatra.
Macquarie Korea Infrastructure Fund
Advised Macquarie Korea Infrastructure Fund (MKIF) on all aspects of the design
and construction contract entered into by the concessionaire (in which MKIF was
investing) with the construction company consortium for the construction of a
US$1.4 billion toll road between Seoul and Chuncheon.
Ministry of Finance, Thailand
Advising the Public Debt Management Office (PDMO) of the Ministry of Finance,
Thailand, on its public-private partnerships (PPP) policy. Allens delivered the
PPP Framework to the government. This is the first PPP work in the country, with
the Thai Government interested in using the method to implement national
infrastructure projects.
Mitsui
Drafting and advising on design, supply and install contract for Thu Duc water
pipeline in Vietnam.
NTT
Advised on the US$194 million North Hanoi fixed line expansion project,
including the business cooperation contract, official approvals and financing.
PetroVietnam
Drafted and negotiated the US$800 million EPC contract with Technip in relation
to the Dung Quat Oil Refinery.
PT Perusahaan Gas Negara (Persero)
Advised PT Perusahaan Gas Negara (PGN) in the South Sumatra to West Java gas
transmission pipeline project in both phase one and two. The second phase of the
project involved a US$350 million financing (US$100 million bridge facility from
ING; US$50 million facility from International Finance Corporation; and US$225
million long-term facility from Asian Development Bank).The Islamic lease
financing was the first of its kind in Indonesia.
PT Semesta Marga Raya
Prepared all relevant documents for the project, including the construction
contract (contractor agreement), Supervisory Consultant Agreement for the
construction supervisor for the toll road, as well as supervisory arrangements
in connection with the utilisation of the financing for the Kanci – Pejagan toll
road project.
Rio Tinto Alcan
Advising on its participation in an aluminium smelter to be constructed in
Sarawak, Malaysia, to be owned by a joint venture consisting of Rio Tinto (60
per cent) and Cahya Mata Sarawak Berhad (40 per cent).
Santos and Inpex
Advised in connection with all aspects of the Bayu Undan natural gas development
project. Advice covered pipeline documentation, LNG issues, the review and
preparation of operating and management agreements and international law advice
in connection with the East Timor/Australia Joint Petroleum Development Area
arising from this US$3 billion project.
Thames Water
Advised on the US$140 million BOT water sanitisation project, Ho Chi Minh City .
