Client Update: Queensland developers and sustainability requirements

In brief: Further to our Focus, the Building and Other Legislation Amendment Bill 2009 has been passed. The provisions we discussed will commence from 1 January 2010. Partner Tony Davies (view CV) reports.
Developers will need to ensure that:
- they review building covenants, community management statements and building management statements for offending provisions; and
- sustainability declarations are properly completed and used as part of the sale process for houses, townhouses and units.
At this stage, a draft declaration has been published but will be amended before it is gazetted. In addition, guidelines will be issued to provide assistance in completing the declarations.
