Business names
A business name registration is simply a statutory requirement and confers no legally enforceable rights.
If you use a name different from your own or your company's name, you need to
register it as a business name in the state or states in which the business is conducted, to enable you to be identified as associated with that business. Accordingly, a business name registration is simply a statutory requirement that confers no legally enforceable rights - it can't be used, for instance, to stop another trader from using your business name or one similar to it (for instance, as a trade mark).
A trade mark registration, on the other hand, confers strong legal rights enforceable against other traders who use, or seek to register, the same or a similar trade mark in respect of the same or similar goods or services.
