In the continuously changing world of financial services, in-depth knowledge of the regulatory and compliance requirements facing financial institutions on a daily basis is an enormous benefit to the industry. Catherine’s expertise in this area enables her to help her finance clients to understand and meet those requirements quickly and cost-effectively.
Catherine leads the firm's Financial Regulation & Compliance group. She is also Deputy Chair of the Law Council of Australia Working Party on Privacy Law.
She advises on all aspects of consumer credit, the Code of Banking Practice, privacy, financial services regulation in the Corporations Act and the ASIC Act, anti money laundering legislation and other regulatory requirements. Her extensive and varied experience allows her quickly to identify the issues and focus her technical legal skills on innovative and effective solutions.
In the ecommerce area, Catherine advises on a broad range of issues relating to electronic delivery of financial services including data aggregation, electronic contract formation, on-line payment systems, website development, trading terms and the Electronic Funds Transfer Code of Conduct.
Catherine is experienced in structuring and documenting third party arrangements including broking contracts, referral agreements with a range of third parties (including insurers), strategic alliances and loyalty programs. She advises on the issues raised by outsourcing.
She has advised on white label arrangements including ones for white label credit card, home loan, deposit and managed investment products. She has structured and advised on white label facilities offered to stockbrokers and managers of cash management trusts or securitisation trusts, including card functionality for securitised home loan borrowers and a full range of transactional banking facilities for unitholders in a cash management trust.
Catherine also advises major financial institutions on a range of other transactional banking facilities for their corporate and institutional customers.
