Guy is an experienced litigator. He has acted for clients in a broad range of corporate, commercial, product liability and administrative law disputes. He is skilled at identifying strategies for dispute resolution and has substantial experience in leading teams in major litigation and public inquiries. His clients include a number of significant manufacturing and resources corporations, investment banks and public sector organisations.
Guy has acted in a broad range of commercial litigation matters, particularly matters arising from contractual and transactional disputes, advertising disputes and corporate collapses and takeovers. He is experienced in asset recovery and corporate fraud work. He acts in securities litigation and in disputes concerning alleged breaches of trust and fiduciary duties.
Guy has also provided strategic advice to manufacturers and distributors on a range of litigious matters, including mass tort litigation. He regularly advises on allegations of negligent design and/or manufacture of products, as well as in relation to compliance programmes and product recalls. He has particular experience with issues relating to the manufacture, registration and subsidising of drugs and medical devices.
Guy has provided advice to a range of commercial clients in respect of their rights to challenge administrative decisions of the ASX, ASIC, the Therapeutic Goods Administration and various other regulatory bodies. He has litigated a number of administrative law challenges in the Administrative Appeals Tribunal and the Federal Court. He has advised government entities on their statutory duties and responsibilities and in respect of their decision making processes.
In addition to his experience in litigating before Tribunals and the Courts, Guy has represented clients in a range of Inquiries and investigatory processes, including liquidators' examinations, ASIC and ASX inquiries and hearings, coronial inquiries, ICAC investigations and Royal and Special Commissions of Inquiry. For example, he acted for Radio 2UE in the Australian Broadcasting Authority's investigation into personal endorsement contracts; for Rail Access Corporation and Rail Infrastructure Corporation in relation to the Glenbrook and Waterfall Special Commissions of Inquiry; and for Allianz in respect of the HIH Royal Commission.
Guy is renowned for his commercial approach and his appreciation of his clients' strategic aims. Independent reviews have nominated Guy as one of the leading litigators in Australia.
